Rental Conditions 1. Prices and Payment1.1 The rental price is calculated on the basis of our net price list plus tax and is due from the date of invoicing. It is valid for each 24 hour period started, commencing from the handover at our premises. The full price for 24 hours is still due even if the actual time in use was less than the full rental period. 2. Scope/parts not included Not included in the rental prices are halogen bulbs; these only have a regular service life of 15 to 25 hours and must be purchased by the customer seperately. 3. Default 3.1 Default in payment If the hirer defaults in payment, we are entitled to charge default interest to the amount of 4% above the respective bank rate of the Deutschen Bundesbank p. a.. In so far as us being able to prove any higher damages caused by the default, then we are entitled to claim these. 3.2 Default with the return of the devices If the device is not returned on time as agreed, the basic rental price plus tax for each 24 hour period started applies plus a 50% surcharge for exceeding the rental period. 4. Collection The hirer collects the devices from the lessor's premises. He is fully liable for transport risk during collection and returning. No shipment is possible. 5. Consequences in the event of non-collection or cancellation If confirmed orders/reservations for devices are not collected, then the customer will be invoiced one days rental for every device ordered/reserved. 6. Liability/Hirers obligations 6.1 On handing over the devices the hirer becomes liable for any loss or damage of the devices. He is liable for the loss in the event of theft as well as for any damages, including those from third parties resulting from the operation or breakdown of the hired devices. 6.2 The hirer must ensure that the hired devices are protected from access by third parties and that they are looked after properly for the duration of the rental period. The hirer is liable for any damages caused by improper use. 6.3 The hirer is prohibited from carrying out any repairs to the devices himself or by third parties. 6.4 The hirer is not permitted to pass on and entrust the devices to third parties . 7. Liability of the Lessor The lessor is not liable for lost revenue, not for indirect or consequential damages, whether they be from the customer or third parties. Any liability for consequential harm casued by a defect or harm through interruption of business is excluded. 8. Desposit Due to the high value of the devices, the customer must pay a deposit amounting to 80% of the their new price . This deposit must be provided either in cash, or in form of a Eurocheque or certified cheque. This deposit is returned by the lessor on return of the devices as long as the devices are in perfect working order. The devices can only be handed over without a deposit to companies with supervision of credit transactions. 9. Place of Performance The domicile of the lessor is the place of performance for all claims relating to the rental agreement. |
